Learned counsel for the respondents states that the present petition has been rendered infructuous, in as much as, extension of two years was granted to the respondent No.3 which period has expired in January, 2018 and the respondents are now in the process of initiating a fresh process for making appointment to the post of Chief Statistician of India. He submits that the said process has also been challenged by the petitioner before the Tribunal and his O.A. is listed for arguments on 09.04.2018. It is stated on behalf of the respondents that in view of the subsequent developments, nothing further survives for adjudication in the present petition. 2.

The petitioner, who appears in person, submits that he does not have any objection to the present petition being disposed of, in view of the fact that the extension of tenure granted to the respondent No.3 has come to an W.P.(C) 12221/2015

end in January, 2018. He, however, submits that the Tribunal has made certain observations in the impugned judgment with regard to the powers and functioning of the ACC under the Transaction of Business Rules which if left undecided, will come in his way in the fresh OA filed by him and pending consideration before the Tribunal.

Liberty is granted to the petitioner to address arguments before the Tribunal on the powers and functioning of the ACC under the Transactions of the Business Rules in the fresh OA filed by him. The Tribunal shall consider the said submission and pass appropriate orders, uninfluenced by the observations made on this aspect in the judgment impugned in the present petition.

With the consent of the parties, the present petition is disposed of, along with the pending applications, as having been rendered infructuous. HIMA KOHLI, J.
