The present petition has been filed under Section 482 Cr.P.C. by the petitioner against the order dated 30.07.2015 passed by the Court below.

Vide order dated 30.07.2015, the Court below dismissed the application of the petitioner under Section 91 of the Cr.P.C.. During the course of arguments, it was revealed that the case of the petitioner is that by moving the application under Section 91 Cr.P.C., he sought the office orders vide which the phone no.7838473103 was kept under surveillance and the communication

and orders passed with regard to the same.

Learned Special PP for CBI has submitted that the whatever documents or materials were available with the Investigating Officer regarding the case, the same has already been supplied to the petitioner during the trial and no other document or material is with him to be provided to the petitioner as sought for. In the facts and circumstances mentioned above, the counsel for the petitioner wishes to withdraw the present petition with the liberty to move an application before the Trial Court under Section 91 of the Cr.P.C. for issuance of directions for production of documents called for from the relevant person having the possession or power of the documents.

I order accordingly.
