O R D E R

% 09.08.2016 It has been submitted by learned Additional Public Prosecutor for the State that the matter earlier came up in the revision petition being Crl.Rev.P. No.719/2015 filed by the accused-respondent which was disposed of by the order dated 6th November, 2015 passed by this Court. The order dated 6th November, 2015 reads as under:- "The petitioner is aggrieved by the order passed by the learned Sessions Judge dated 02.09.2015. The petitioner is aggrieved by only that portion which reads as under:- "At best, prima facie case on the basis of the facts alleged on this particular aspect, a case for offences punishable under Section 363 read with 511 IPC is made out against accused Lalit Aggarwal, which is exclusively triable by the court of Ld. Metropolitan Magistrate".

The observations made by the Sessions Judge qua this aspect is set aside and it is left open to the Magistrate to decide as to whether prima-facie offence under Section 363 read with Section 511 of the IPC or any other offence as has been detailed in the charge-sheet is made out.

With these directions, this petition is disposed of."

The present revision petition and application are disposed of in the same terms and conditions.
