% 04.01.2016 Crl.M.A. 09/2016 Application is disposed of subject to just exceptions. Bail Appln. 03/2016 The present application under Section 439 of the Cr.P.C. has been filed for the grant of regular bail in FIR No.1624/2015, under Section 308/34 IPC, Police Station Tilak Nagar. The allegations levelled in the present case by the complainant Jogender Singh made in a statement to the police are that on 14.11.2015, he along with dairy owner Chandan Singh were present
in the shop and their vehicle was lying parked on the road. At about 05.30 a.m., three boys came in a car and started abusing for parking the vehicle on the road. When objected to the abuses, the car driver came and gave slaps to Chandan Singh. Thereafter, that boy called his co-accused Inderjeet and Santa Singh who came there with a hockey stick. The car driver took the hockey and hit the same on the head of Chandan Singh, while the co-accused persons caught hold of Chandan Singh.
Public persons gathered at the spot and accused/ petitioner Sarabjeet Singh was apprehended at the spot, whereas the co-accused persons fled away in the car.
The accused is stated to have been arrested on 14.11.2015. The injury attributed to the accused is simple in nature. Perusal of record shows that the accused is behind the bar since 14.11.2015. In the facts and circumstances, the present application is allowed. The accused/petitioner is ordered to be released on bail on furnishing the personal bond in the sum of Rs.25,000/- with two sureties in the like amount to the satisfaction of the Court concerned. The petitioner is directed to join the investigation as and when required.
He shall not tamper with the evidence and shall not
influence the prosecution witnesses. He is also directed not to leave the country without prior permission of the Court concerned. However, it is made clear that the observations made above shall not have any bearing on the merits of the case. The present application is disposed of accordingly. P.S.TEJI, J JANUARY 04, 2016 dd
