% 06.04.2016 I.A. No.4439/2016 This application has been jointly moved by the parties to record their settlement. The application is signed by the parties and their respective counsels. The application is also supported by the affidavit of Mr. Suman Ghosh, defendant no.1, who is the proprietor of defendant no.2 and Col. J.K. Sharma (Retd.), the constituted attorney of the plaintiff. The terms of the settlement appear to be fair, just and reasonable and I see no impediment in accepting the same. Accordingly, the suit is disposed of as settled in terms of the settlement, which shall continue to bind the parties. The decree shall be drawn in terms of prayer made in para 43(i) (a)(b) & (iii).

Since the suit has been settled at the initial stage, the plaintiff shall be entitled to refund of 50% of the court fee.
