% 09.05.2017 After some hearing, learned counsel for the petitioner submitted that in view of the objections by the NHAI with respect to the maintainability of mixed questions of facts and law, liberty may be granted to file a suit before the competent court. Subject to grant of such liberty, learned counsel submits that the writ petition may be permitted to be withdrawn. The petitioner is at liberty to approach the Civil Court for appropriate relief in accordance with law.

The writ petition is accordingly dismissed as withdrawn along with the pending application.
