% 15.05.2017 The petitioner has sought a direction to the respondents to deport him to Pakistan forthwith.

The petitioner was made an accused in a case involving various sections of the IPC dealing with the offences of waging war against the Government. For all such offences, the petitioner was acquitted, however, the petitioner was convicted under Section 14 of the Foreigners Act and was sentenced to undergo imprisonment for five years. The petitioner has suffered the aforesaid imprisonment and after being released from jail, he has now been detained in the Detention Centre at Lampur. Ms.Nandita Rao, learned Additional Standing Counsel informs this Court that as against the judgment of acquittal of the petitioner, an appeal was filed before the High Court which too was dismissed. Against the order of dismissal by the High Court, SLP has been preferred in which notices

have been issued. As such the prayer of the petitioner cannot be allowed. After coming to know of this development, learned counsel for the petitioner seeks permission to withdraw this petition in order to file a fresh petition later at an appropriate time.

Dismissed as withdrawn.
