On the last date of hearing, Court Notice was directed to be issued to the parties. The same remained unserved qua the appellant with the report that the concerned person has expired. Learned counsel appearing for the respondent/CBI, upon instructions, states that the factum of death of the appellant has been verified. It is further submitted that the appellant has also been convicted in another case, in respect of which, another appeal bearing Crl.Appeal no.941/2017 was filed and in the said case, vide order dated 11.09.2023, the factum of the death of appellant was verified, and a status report along with death certificate of the appellant in this regard has already been filed in that matter. The copy of the order dated 11.09.2203 has been handed over in the Court today.
