% 28.03.2016 C.M.No.11404/2016 Present application has been filed seeking a direction to the respondent to change the Constitution of the petitioner No.1 in their records in accordance with the observations and directions of this Court in judgment and order dated 23rd December, 2015, by virtue of which the present writ petition was disposed of. Since despite service of an advance copy of the present application upon the respondent, none appears for the respondent, this Court has no other option but to proceed ahead with the matter. Learned counsel for petitioners states that the respondent vide a non-reasoned order dated 27th January, 2016 has informed the petitioners that petitioner No.3 i.e. Bhabhi is not included in the definition of family. He states that respondent has completely ignored

the fact that petitioner No.3 was the original allottee and a co-owner in her independent right as she is the partner of petitioner No1. A perusal of the paper book reveals that the argument advanced by learned counsel for petitioners is correct on facts. Consequently, present application is allowed. Order dasti.
