No.353/2016 The impugned order is the order dated 01.4.2015 vide which the application filed by the defendant seeking a rejection of the plaint under Order VII Rule 11 CPC had been allowed; the suit stood dismissed. This amounts to a decree under Order II Rule 2 CPC. An appeal is maintainable not the revision petition. Permission is granted to the petitioners to withdraw this petition with liberty granted to them to take appropriate remedy as available in law.
