O R D E R

% 25.01.2017 Present petition has been preferred by the petitioners for quashing of FIR No.1057/2015, under Sections 307/452/506/323/34 IPC, registered at PS Uttam Nagar.

Learned counsel for the petitioners submits that that petitioners and respondent No.2 are the neighbourers, but due to temperamental differences and misunderstanding between them, a quarrel had taken place which resulted into registration of the said FIR. He further submits that with the help of near relatives and close friends, they have amicably settled all their disputes and differences and the settlement has been reduced into writing vide Memorandum of Understanding dated 05.10.2015. He further submits that since all disputes have been amicably settled between the parties and nothing remains to be adjudicated upon further and also in order to upkeep

better relationship between neighbourhood, the FIR in question and all proceedings arising therefrom may be quashed. The respondent No.2 is present before the Court and has been identified by IO S.I Raj Pal. I have enquired from respondent No.2 whether the matter has been settled with the petitioners without fear and pressure. He has stated that the matter has been settled without any fear or pressure and there is no dispute among them. He further submits that he has no objection to the quashing of the FIR in question.

Keeping in view the facts and circumstances of the case and the fact that the matter has been amicably settled between the parties and also to enable the parties to have better neighbourhood relationship, the FIR No. 1057/2015, under Sections 307/452/506/323/34 IPC registered at PS Uttam Nagar and all proceedings arising of the same are hereby quashed. The present petition is disposed of accordingly. Copy of this order be given dasti.
