% 26.02.2016 The petitioner has filed the present petition, inter alia, seeking setting aside of notice dated 30.07.2014 and letter dated 03.10.2015 issued by respondents.

Mr. O.P. Gaggar, learned counsel for respondents submits that notice dated 15.07.2015 has been issued but the amount of gratuity has not been forfeited.

After some arguments, learned counsel for the petitioner submits that the petitioner will make representation to the respondents within a period of one week and respondents may consider the same in accordance with law. Learned counsel for respondents submits that after receiving the petitioner's representation, the same shall be decided within a period of four weeks.

Learned counsel for the petitioner submits that the petitioner is

satisfied with the aforesaid and seeks permission to withdraw the present petition.

As prayed, the petition is dismissed as withdrawn. However, the petitioner is at liberty to move a representation to the respondents within one week and the respondents will decide the same within a period of four weeks thereafter.
