% 01.02.2016 Crl. MA 1273/2016 This is an application under Section 482 Cr.PC moved by the petitioners for cacellation of non-bailable warrants issued by the Trial Court. Since in this application, petitioner is seeking anticipatory bail, application for cancellation of non-bailable warrants issued by the learned Trial Court is not maintainable before this Court.
The application is accordingly dismissed with liberty to the petitioners to move appropriate application before the Trial Court. The application stands disposed of.
Bail Appln. 33/2016 Except for making one averment that the petitioners are innocent and have been falsely implicated in this case, no other plea has been taken seeking bail. Probably the same stand was taken before the learned Additional Sessions Judge and therefore, while dismissing the application it was observed that except for pleading that the petitioners are innocent, no other averment has been made.
Counsel for the petitioners seeks to withdraw this application with liberty to file fresh application before the learned Additional Sessions Judge making all averments. The application stands dismissed as withdrawn. Liberty as prayed for is granted.
