% 27.09.2017 CM APPL. 35916/2017 & WP(C) No.781/2016 The matter has been fixed for 2.11.2017 taken up today on the above application which has been filed as joint application on behalf of the petitioner and the respondent under Order XXIII Rule 3 CPC seeking that the settlement arrived at between the parties as stated in para 4 of the application be recorded and appropriate orders be passed.
The statements of the authorized representative of the petitioner and the respondent who are present in person and duly identified by their learned counsel whose vakalatnamas are on record have been recorded. A Demand Draft No.018830 in the sum of Rs.9.00 lakhs dated 26.9.2017 drawn on Axis Bank Limited in the name of the
respondent has been handed over to the respondent today in Court. Photocopy of the demand draft is on record and has been exhibited as CW1/C.
It is stated on behalf of the petitioner and the respondent who is present in person that in terms of the said settlement arrived there are no further claims left between the parties in relation to the the Award dated 29.07.2015 in LIR No. 1293/2011 of the Presiding Officer, Labour Court-XIX, Karkardooma Courts and that the respondent does not seek any reinstatement of his services nor any backwages from the petitioner. On behalf of the petitioner it has also been stated that there are no further claims left between the parties qua W.P.(C) 781/2016. In view thereof the parties are directed to remain bound by the terms of their settlement in terms of CM No.35916/2017 and statements made by them.
The date 02.11.2017 is cancelled.
