Counter affidavit has not been filed. However, counsel for the respondents orally opposes the maintainability of the present petition in this Court on the ground that Clause 19 of the Notice issued by the Staff Selection Commission (SSC) for recruitment to the post of Sub Inspectors, specifies that any dispute with regard to the recruitment shall be subject to courts having jurisdiction over the city/town in which the concerned Regional/Sub-Regional Office of the SCC is situated and where the candidate has submitted his application. He submits that in the present case, the petitioner has submitted his application at Allahabad, UP and therefore this Court is not vested with the territorial jurisdiction to entertain the present petition.

Counsel for the petitioner states that he may be permitted to withdraw the present petition, while reserving the right of the petitioner to approach the competent court vested with the territorial jurisdiction to entertain the petition.
