Nagesh, learned counsel for the plaintiff submits he is instructed to request for permission to withdraw the suit and also to seek liberty to file fresh appropriate proceedings in view of the issues arising out of arbitration clause and concerning jurisdiction. The only objection taken by the counsel for defendant No.2 is that there is no arbitration clause. The suit and pending applications are dismissed as withdrawn with liberty as prayed.
