This petition seeks appointment of the petitioner to the post of Aganwadi Worker. It is the petitioner‟s case that she has been working as Aganwadi Helper for the last few years. It is also the case of the petitioner that other Aganwadi Helpers have been considered and appointed as Aganwadi Workers in terms of the panel list prepared by the respondents in the year 2012. The last Aganwadi Helper appointed to the post of Aganwadi Worker was at serial no.23 in the said list. The petitioner‟s name figures at serial no.38 in the said list. It is submitted that after 2012 no appointments have been made to the post of Aganwadi Worker.

In reply to the petitioner‟s notice 04.09.2013, CDPO, ICDS Kanjhawla of the Department of Women & Child Development, Government of NCT of Delhi stated that:
".........IT is stated that there are vacancies against Retirement cases in Kanjhawala Project but
which are to be filled up out of the panel which is to be prepared in near future or through transfer cases from other projects as per the eligibility. Selection of candidates for the Panel list will be done by the selection committee constituted at District level as per procedure and Smt. Suman Lata will have to go through the selection process"

Learned counsel for the petitioner concedes that there have been no appointments to the said post against the said vacancy till date. In the circumstances the Government of NCT of Delhi would fill the vacancies when it is deemed appropriate. When such process is undertaken, the petitioner‟s name would be considered in terms of the aforesaid letter.
