BAIL APPLN. 176/2016 (1) The petitioner seeks regular bail in case FIR No.247/15 under Section 376 IPC and Section 6 POCSO Act registered at Police Station Patel Nagar. Status report not filed. BAIL APPLN. 176/2016

(2) I have heard the learned counsel for the parties and have examined the file. The petitioner is in custody since 19.03.2015. The prosecutrix is aged around 17 years.

Friendship had developed between the prosecutrix and the appellant and they used to remain in touch on phone. Physical relations were established with consent on various occasions.

She allegedly became pregnant and informed about it to the appellant. When the appellant declined to marry, the FIR was lodged after considerable delay.

Charge-sheet has since been filed.

(3) Considering the facts and circumstances of the case, the petitioner is admitted to bail on his furnishing personal bond in the sum of `40,000/-with one surety in the like amount to the satisfaction of the Trial Court.

(4) The application stands disposed of.
