None appears for the defendant no.3 Educomp Learning Hour Pvt. Ltd. 5.

The suit is dismissed as withdrawn, leaving the parties to bear their own costs.

The counsel for the plaintiff seeks refund of court fees. 7.

In accordance with Section 16A of the Court Fees Act, 1870 as applicable to Delhi, 50% of the court fees paid on the plaint be refunded to the plaintiff.
