#22 $~ * IN THE HIGH COURT OF DELHI AT NEW DELHI + CONT.CAS(C) 12/2016 RAMAN KANT KAPIL AND ORS ..... Petitioners Through Mr. Sanjeet Ranjan, Advocate versus G MOHAN KUMAR AND ANR ..... Respondents Through Mr. Vikas Mahajan, CGSC with Mr.
S.S. Rai, Advocate
CORAM:
HON'BLE MR. JUSTICE MANMOHAN
O R D E R
% 08.01.2016 Present contempt petition has been filed alleging wilful disobedience of the judgement dated 26th May, 2015 passed in W.P.C 5425/2015 whereby the Division Bench directed the respondents that if any vacancy exists in the post of Programmer, the respondents should take steps to hold a DPC to consider the case of all eligible employees for the promotional post within a period of four months.
Learned counsel for the petitioner states that though the respondents have vacancies available, yet no DPC has been held since 2009. He also states that the DPC should fill up the vacancies in accordance with the Recruitment Rules.
CONT.CAS(C) 12/2016
Learned counsel for respondents states that the DPC is being convened on 11th January, 2016.
In the opinion of this Court, in contempt jurisdiction the Court cannot supplement the directions given by the Division Bench. Consequently, no direction can be issued directing the DPC to decide the cases in a particular way. Moreover, as the counsel for respondents has already stated that DPC is going to be convened on 11th January, 2016, present contempt petition is disposed of as satisfied.
