This petition seeks a rectification of judgment dated 3 April 2024, whereby WP (C) 5857/2023 was dismissed. This Court had expressed its inability to grant relief to the petitioner as the petitioner had been shortlisted by the DoE for admission to KG/ Pre-Primary in the respondent-school for the 2021-2022 academic session, which has drawn to a close.

This petition seeks a modification of the said order, by incorporating a direction to the DoE to admit the petitioner in another school in Class I for the 2024-2025 academic session. Though it is true that such a direction was issued by this Court in Jiya v. Agrasen Model School1, this Court has since been apprised by the DoE that the direction cannot be implemented as, for the next year, the student would have to compete with other students who are seeking admission, as EWS students, in the next higher class. 3.

Accordingly, the highest that the Court can do, for the petitioner, is to grant liberty to the petitioner to apply with the DoE for admission to Class I for the academic year 2024-2025. 4.

Any such application, if made, would be considered by the DoE and proceeded with in accordance with law.
