This is an application under Section 151 CPC filed on behalf of applicant/respondent no.1 seeking extension of time in initiating action against petitioner in terms of the order dated 22.08.2022. 2.

Mr. Goyal, learned counsel for the applicant/respondent no.1 submits that original order which was passed by the Department was set aside by the learned Single Judge of this Court and was upheld by the learned Division Bench and the SLP theiragainst was dismissed by the Hon'ble Supreme Court. However, the Supreme Court, vide the order dated 06.10.2023 had granted liberty to the respondent / Union of India to approach this Court for extension of time for concluding The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the disciplinary proceedings.

Mr. Mohanty, learned counsel for the non-applicant/petitioner vehemently opposes the said prayer and submits that the order allowing the writ petition was passed by this Court on 22.08.2022, whereafter an appeal filed by Union of India by way of an LPA No.88/2023 was also dismissed on 03.05.2023. Subsequently, the same was carried to the Supreme Court by way of SLP (Civil)/ Diary No(s). 33859/2023 which was also dismissed on 06.10.2023. That apart, he submits that the petitioner has already challenged the disciplinary proceedings before this Court by way of W.P.(C) 4309/2024 in which vide the order dated 21.03.2024, this Court had issued notice.

As a last and final opportunity, this Court grants precisely four weeks time commencing today for the proceedings to conclude. In case the proceedings are not concluded by that time, no further extension of time shall be granted.
