This is an application filed on behalf of the judgment debtor seeking release/refund of the amount deposited by the judgment debtor amounting to Rs. 5,63,00,000/- along with interest.

Admittedly, the award dated 08.05.2015 has been set aside by the Division Bench in FAO(OS)(COMM) No. 47/2021 on 30.10.2023.The SLP filed by the decree holder against the said judgment has also been dismissed. 3.

In this view of the matter, the judgement debtor is entitled to the refund of the amount of Rs. 5,63,00,000/- lying deposited in this Court in the form of bank guarantee.

The registry is directed to encash the bank guarantee and return the amount to the judgement debtor along with accrued interest. 5.

Mr. Wadhwa, learned senior counsel appears for the judgment debtor and states that under Section 144 of CPC, the judgment debtor is entitled to be resituated towards the interest component. 6.
