HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.63 OF 2019 ORDER: (per V. Ramasubramanian, J) Challenging the measures taken by the Authorized Officer under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, the petitioner, who claims to be a tenant in respect of the secured asset, has come up with the above Writ Petition.

2. Heard Sri D. Raghavulu, learned counsel for the petitioner, and Smt. V. Dyumani, learned standing counsel for the bank.

3. Today, the petitioner has filed an affidavit of undertaking, seeking only three (03) months time to vacate and hand over vacant possession. The affidavit of undertaking is taken on record.

4. Since the petitioner is a tenant from the year 2015, we are of the view that the time sought can be granted. Therefore, the writ petition is disposed of granting time to the petitioner up to 30.04.2019 to vacate and hand over vacant possession. But, till then, the monthly rent shall be remitted to the bank. However, there shall be no order as to costs.

As a sequel, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
