HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.7 of 2018 ORDER:

This writ petition is filed seeking the following relief: " ..to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents in entertaining to establish another A4 shop by way of shifting at Door No.781, Penagalur, YSR Kadapa District is illegal, arbitrary and in violation of 19(1)(g) and 300-A and consequently direct the respondents not to permit the 5th respondent A4 shop shifting near to the petitioner's A4 shop and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.'

Heard learned counsel for the petitioner and learned Government Pleader for Prohibition and Excise appearing for respondents 1 to 4. Perused material record.

The only grievance of the petitioner in this writ petition is with regard to the action of the respondent authorities in entertaining the application of the fifth respondent to establish another A4 shop by shifting the same from its existing premises to a place nearer to the petitioner's A4 shop.

Learned Government Pleader appearing for respondents 1 to 4 would submit that no proposal for shifting of any such A4 shop of the fifth respondent is pending consideration with the second respondent. 5.

Recording the submissions, the writ petition is disposed of directing respondents 1 to 4 to put the petitioner on notice, if there is any proposal for shifting of A4 shop of the fifth respondent to a place nearer to the petitioner's A4 shop and consider the objections, if any, of the petitioner before taking considered decision in the matter. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. _____________________ M.
