HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 10691 of 2017 Order:

This Writ Petition is filed challenging the action of the third respondent in proceeding with the investigation in FIR No.452 of 2016 dated 27.11.2016 against the petitioner, who is accused, without following the due process of law.

Since the grievance of the petitioner is to follow due process of law while investigating the crime, this Writ Petition is disposed of directing the third respondent to follow due process of law including compliance with Section 41-A of the Code of Criminal Procedure and proceed with the investigation.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
