THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6339 OF 2016 ORDER:

This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.822 of 2014 on the file of the Specal Mobile Magistrate, Guntur.

Heard and perused the material available on record. It is alleged that a wall poster in the name of the petitioner, who is contesting for MLC from the graduates constituency of Krishna and Guntur Districts, was affixed on the western side of compound wall of Bungalow of the District Collector, Guntur on 15.2.2013. Thus, the petitioner is alleged to have committed the offence punishable under Section 4 of A.P. Prevention of Disfigurement of Open Places and Prohibition of Obscene and Objectionable Posters and Advertisements Act, 1997.

Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to interfere with the proceedings in the above case. At this stage, the learned Counsel for the petitioner has prayed for dispensing with the presence of the petitioner before the trial Court. In view of the above submission, the presence of the petitioner before the trial Court is dispensed with, except on the dates when his presence is specifically insisted by the trial Court. The petitioner is directed to be represented through a Counsel before the trial Court on all hearing dates.

Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________________ JUSTICE RAJA ELANGO Date : 26.4.2016 Nn
