04.11.2025 CVBR,J I.A.No.2 of 2025 This application is filed seeking to modify the order dated 03.04.2025 passed by this Court in W.P.No.49 of 2025.

This Court vide order dated 03.04.2025, disposed of the Writ Petition No.49 of 2025 with the following observations:

"In view of the same and as the grievance of the petitioner is that even after lapse of nearly 15 years, the appeal filed by him was not numbered and decided, this Court, without expressing any opinion with regard to the mérits of the case deems it appropriate to dispose of the writ petition by directing respondent No.3 to transfer the appeal preferred by the petitioner on 26.03.2010 to the Special Tribunal constituted under the provisions of the ROR Act, 2020 for disposal of the same, within a period of eight (08) weeks from today and on receipt of the same, the Special Tribunal is directed to dispose of the said appeal within three (03) months thereafter."

The learned counsel for the petitioner has submitted that pending consideration of the appeal filed by the petitioner, the State Legislature has repealed the Telangana Rights in Land and Pattadar Pass Books Act, 2020 ('ROR Act, 2020') and enacted Telangana Bhu Bharati (Record of Rights in Land) Act, 2025 (Act 1 of

OFFICE NOTE 2025). It is contended that under the provisions of the new Act, the Revenue Divisional Officer is now competent to decide grievances arising from proceedings issued by the Tahsildar, and therefore, the appeal should be dealt with under the new enactment.

It is pertinent to state that as per Section 16 of the ROR Act, 2020, the Special Tribunal was constituted and pending matters were transferred to the Special Tribunal vide G.O.Ms.No.4 Revenue (Assignment-I) Department dated 12.01.2001. Admittedly, as on the date of passing order dated 03.04.2025 in W.P.No.49 of 2025, the ROR Act, 2020 was in force. Therefore, even if any subsequent enactment is made by the State Legislature, the appeal filed by the petitioner is required to be disposed of by the Special Tribunal constituted under the ROR Act, 2020. Therefore, the present application is misconceived and liable to be dismissed.

Accordingly, this application is dismissed.
