THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.15 OF 2024 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/accused No.4 in Crime No.1261 of 2023, on the file of Saroornagar Police Station, Rachakonda, Ranga Reddy District, registered for the offence punishable under Sections 8 (c) r/w 20 (b) (ii) (B) and 22 of NDPS Act, 1985 r/w.34 of IPC. 2.
Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

This petitioner and three other students who were arrayed as A-1 to A-3 were arrested by the Saroornagar Police for consumption of ganja and for being in possession of 2kgs. of ganja. They were sent to judicial remand after being produced before the concerned Court.

Learned counsel appearing for the petitioner would submit that the petitioner is a student and his exams are scheduled on 04.10.2024, 06.01.2024 and 08.01.2024 and the hall ticket with regard to the said exams is also filed. 5.
On instructions, learned Additional Public Prosecutor would submit that there are no other cases against this petitioner.

Keeping in view that the petitioner is a student and his exams are scheduled on 04.06.2024, 06.01.2024 and 08.01.2024 and further this petitioner is identified as consumer of ganja, the relief of regular bail can be considered, subject to following conditions:
i) The petitioner/accused No.4 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of V Additional Junior Civil Judge-Cum-V Additional Metropolitan magistrate, L.B.Nagar, Ranga Reddy District.
ii) The petitioner/accused No.4 after release shall appear before the concerned Station House Officer at 10:00 a.m. from 10.01.2024 to 16.01.2024 and
thereafter, as and when required for the purpose of investigation.
iii) The petitioner/accused No.4 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, pending if any, shall stand closed.
