THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.43118 of 2015 ORDER:

The grievance of the petitioner was with regard to the inaction of the police authorities in investigating Crime No.49 of 2012 on the file of Humayun Nagar Police Station.

Written instructions dated 25.01.2016 were furnished by the Inspector of Police, Humayun Nagar Police Station to the office of the learned Government Pleader for Home, wherein he stated that upon the complaint made by the petitioner, Crime No.49 of 2012 was registered under Sections 379 and 506 I.P.C. read with Section 34 I.P.C. on the file of Humayun Nagar Police Station. However, the police authorities did not find that a prima facie case was established and therefore filed a final report under Section 173 Cr.P.C. referring the case for 'Lack of Evidence'. This final report was filed under S.R.No.4588 of 2015 before the learned VI Additional Chief Metropolitan Magistrate, Nampally at Hyderabad. In the light of the aforestated developments, it is for the petitioner to take recourse to appropriate remedies in accordance with law if he is aggrieved by the conclusion arrived at by the police authorities.

Reserving liberty to the petitioner to do so, the writ petition is closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
