THE HON'BLE SRI JUSTICED A.RAJASHEKER REDDY W.P.NOS.10, 12,13, 14, 76, 99, 119, 128, 133, 134, 136, 138, 139, 144, 158, 170, 185, 1472, 1476, 1484, 1488, 3578, 3604, 4285, 4435, 7124, 11449, 17398, 17443, 17570, 22351, 23140, 23162, 23265 & 23657 OF 2019 COMMON ORDER The grievance of the petitioners in all these writ petitions is that the respondent - Municipal Authorities, are not accepting their applications for grant of building permissions on the ground that the subject plots falls under unapproved layout and is not recognized within the scheme introduced by the 1st respondent vide G.O.Ms.No.151 Municipal Administration and Urban Development (M1) Department dated 02.11.2015.
Learned counsel for the petitioners, as well as the learned Special Government Pleader appearing for learned Advocate General for respondents and the learned Standing Counsel appearing for respective municipalities, appearing for respondents, in consonance, submits that following Memo No.2252/M1/2017 dated 28.04.2017, this court in identical set of facts and circumstances, in W.P.No.23191 of 2017 dated 24.10.2017, directed the respondents to accept and process the application of the petitioner therein and pass appropriate orders as per law. The learned counsel submits that the said order of the learned Single Judge has become final, as no one has filed any appeal. Learned counsel further submits that the memo issued by 1st respondent dated 28.04.
2017, is also not under challenge in any of the writ petitions so far, and following the order passed by the learned single Judge, several other writ petitions have also been disposed of. It is further stated that 1st respondent also filed counter affidavit in one of the writ petitions in the batch in W.P.No.3578 of 2019, justifying the issuance of memo dated 28.04.2017. Having regard to the facts and circumstances and the submissions of the learned counsel and for the reasons alike as recorded in W.P.No.23191 of 2017 dated 24.10.
herein for building permissions in terms of the Memo No.2252/M1/2017 dated 28.04.2017 issued by the 1st respondent, and pass appropriate orders, as per law.
Interlocutory applications pending, if any, shall stand closed. No order as to costs.
