Mr Mohd Bin Salam Bin Siddiq v. The State Of Telangana
HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.109 of 2020 ORDER:
According to the petitioner, he owns several extents of land in various survey numbers of Venkatraopet Village, Talkondapally Mandal, Mahaboobnagar District.
The grievance of the petitioner is that insofar as the land to an extent of Acs.10.22 guntas in Sy.Nos.79/A, 79/E/1, 218/A/1 and 218/EE/1 of the same village, in the Revenue records, the petitioner's name is shown as pattadar, but in the occupation and possessor column, the name of unofficial respondent No.4 is entered. Pointing out that wrong entries were made, the petitioner made a representation dt.30.07.2019 to the Revenue Divisional Officer, Kandukur, to correct the same. Alleging inaction on the said representation, this writ petition is filed.
2.
Learned counsel for the petitioner does not dispute that the Revenue records show the name of respondent No.4 in the occupation and possessor column. Whether such entry was preceded by affording an opportunity to the petitioner and when such entries were made are not clearly stated. 3.
Be that as it may, against the entries made by the Tahsildar in the Revenue records, remedy of appeal provided under the A.P. Rights in Land and Pattadar Pass Books Act,
PNR,J W.P.No.109 of 2020 1971 (for brevity "the Act"). Without availing the said remedy of appeal, the petitioner made a representation dt.30.07.2019 to the Revenue Divisional Officer. Once entries are made, the Revenue Divisional Officer has no power to undertake review of the entries made and the same are to be corrected in accordance with the procedure prescribed under the Act. Therefore, the grievance of the petitioner that there is inaction by the Revenue Divisional Officer in acting upon his representation cannot be appreciated and no relief can be granted to the petitioner.
4.
Therefore, granting liberty to the petitioner to avail the remedy of appeal, if otherwise permissible under law, the writ petition is dismissed. No order as to costs.
5.
Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
