This Transfer CMP is filed by the petitioner/wife to withdraw HMOP.No.592 of 2015 filed by respondent/husband from the file of Family Court, Vijayawada and transfer the same to Family Court, Visakhapatnam to be tried along with FCOP.No.890 of 2015.
The case of the petitioner is that the marriage of petitioner was performed with respondent on 02-09-2010 at Alluri Seetharamaraju Kalyana Mandapam, Vijayawada as per Hindu rites and customs. After the marriage, she joined with respondent at Vijayawada and later shifted to Bathinda in Punjab State, where the respondent got job. Later, the respondent was pressurizing the petitioner for mutual divorce and unable to bear the pressure from him, she went to her parents house in the month of September, 2014. Later, the petitioner filed FCOP.No.890 of 2015 at Family Court, Visakhapatnam seeking maintenance. It is stated that the respondent filed HMOP.No.592 of 2015 at Family Court, Vijayawada seeking divorce.
The petitioner has no male assistance and financial support and depending on her old aged mother. As such, she is not in a position to travel from Visakhapatnam to Vijayawada. Hence, the transfer CMP is filed. Though notice is sent and served, there is no appearance and no counter is filed by the respondent. The facts narrated in the petition filed in support of the Transfer CMP are uncontroverted. It is stated that the petitioner has no male assistance and no financial support to travel all the way from Visakhapatnam to Vijayawada. The petitioner filed FCOP.No.890 of 2015 at Family Court, Visakhapatnam and the respondent has to attend the same. In view of the above, I deem it proper to withdraw FCOP.No.592 of 2015 from the file of Family Court, Vijayawada and transfer the same to the Family Court, Visakhapatnam to be tried along with FCOP.No.890 of 2015, where it is pending. Accordingly, the Transfer CMP is allowed. Miscellaneous petitions pending, if any, in the Tr.CMP. shall stand closed. _________________________ A.RAJASHEKER REDDY,J 11-12-2015
