THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION NO.12260 of 2016 ORDER :

This Criminal Petition is filed under Section 482 Cr.P.C. to quash the proceedings in Crime No.111 of 2016 of Gandepalli Police Station, East Godavari District, registered for the offences punishable under Sections 447, 427, 379, 354(A). 323, 506 r/w 34 I.P.C.

2. Heard learned counsel for the petitioners and learned Additional Public Prosecutor representing the State.

3. It is represented by the learned counsel for the petitioners that for the same occurrence, the petitioners/accused filed complaint even prior to the 2nd respondent filing the complaint. But, however, the police have not registered their crime first and after registering the complaint lodged by the 2nd respondent herein as crime No.111 of 2016, the police registered their case in crime No.112 of 2016.

4. In that view of the matter, this Criminal Petition is disposed of directing the investigating officer to investigate both the crimes simultaneously and file final reports also simultaneously.

5. As a sequel thereto, miscellaneous petitions, if any, pending in this Criminal Petition, shall stand dismissed. _______________ M.S.K.JAISWAL, J Date:24.08.2016 pab
