THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Crl.M.P.No.8182 of 2015 In/And Criminal Petition No.8178 of 2015 ORDER:
This Criminal Petition has been filed by the petitioner/accused under Section 482 of the Code of Criminal Procedure, 1973 seeking to quash the proceedings in SC.No.52 of 2014 on the file of the learned Special Judge for Trial of Offences under Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act-cum-V Additional Sessions Judge, Nellore.

When the matter is taken up for hearing, the learned counsel for the petitioner/accused and the 2nd respondent/complainant had submitted that the parties had entered into a compromise and settled the matter out of Court and that the terms of compromise are reduced into writing in the form of a memorandum of compromise and that the Crl.M.P.No.8182 of 2015 is filed seeking permission to compound the offences and to quash the proceedings.

The petitioner/Accused and the 2nd respondent/complainant are present. They have been duly identified by their respective counsel. Both the parties had asserted the terms of the Memorandum of compromise.
4. This court is satisfied that the parties had entered into compromise voluntarily with free Will and consent. In view of the settlement arrived at between the parties no purpose would be served in keeping the proceedings pending. Therefore, in view of the enabling provision in the CrPC, permission is hereby accorded and the compromise is recorded.

Accordingly, Crl.M.P.No.8182 of 2015 is ordered and Criminal Petition No.8178 of 2015 is allowed and the proceedings against the petitioner/accused in SC.No.52 of 2014 on the file of the learned Special Judge for Trial of Offences under Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act-cum-V Additional Sessions Judge, Nellore are hereby quashed. The Memorandum of Compromise shall form part of this order.
Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
