THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.112 of 2019 ORDER:

The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, the petitioner prays that this Hon'ble Court may be pleased to issue an appropriate writ, direction or order, more particularly one in the nature of Writ of Mandamus declaring the action of respondent No.3 in not taking any action in pursuance of the notice dated 12.9.2018 in GP/NKP/179/2018 even after the constructions made by respondent No.4 in Sy.Nos.53 and 54 of Neknampur Vilalge, Gandipet Mandal, Ranga Reddy District as being illegal, arbitrary and is in violation of Articles -14 and 21 of the Constitution of India apart from in violation of principles of natural justice and fair play and consequently direct respondent No.3 to forthwith remove the illegal constructions made by respondent No.

4 in the aforesaid land and report compliance to this Hon'ble Court and pass such other order or orders as are deemed fit and proper." In the light of the order that this Court proposes to pass, it would not be necessary to put the fourth respondent on notice or give him an opportunity of hearing.

As the Neknampur Gram Panchayat, Gandipet Mandal, Ranga Reddy District, the third respondent, appears to have issued notice dated 12.09.2018 pursuant to the complaint made by the petitioner, it is for it to take appropriate action in the matter in accordance with law after giving due opportunity of hearing to all affected parties. The writ petition is accordingly disposed of directing the third respondent-Gram Panchayat to take necessary action as per law and as warranted pursuant to its notice dated 12.09.2018 after giving due opportunity of hearing to all affected parties, including the petitioner. This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order.
