THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.3949 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of 2nd respondent in not registering nor undertaking adjudication of the Arbitration Application dated 22.11.2016 filed by the petitioners, aggrieved by the Award No.5/2016/NH-565, dated 08.03.2016 in Rc.No.G1-2581-2014 passed by the 3rd respondent, as illegal, irregular, irrational and amounts to non discharge of legal obligation conferred on 2nd respondent under section 3-G(5) of National Highways Act, 1956 and rules framed there under and offends article 14 of the constitution of India and consequently direct the 2nd respondent to take the said Arbitration Application on file, number the same and decide the same in accordance with law by enhancing compensation appropriately."

When the matter is called, it is represented by the learned counsel for the petitioners so also the learned standing counsel for National Highways, Sri S.S.Varma, that the arbitration applications pertaining to the subject properties including the applications of the petitioners have

AVSS,J W.P.No.3949 of 2017 been registered and process is on in the direction of fixation of the date of hearing.

In view of the above submission, this writ petition is disposed of, directing the respondents herein to complete the proceedings, as expeditiously as possible, in accordance with law.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
