HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.23276 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India challenging the letter dated 19.12.2015 in Lr.No.AAE/ICSC/Charminar/F:Rejected/D.No.719 issued by the third respondent rejecting the application of the petitioner for grant of power supply connection as illegal and arbitrary and consequently direct the respondents 1 to 3 to issue service connection to the premises bearing H.No.18-4-372, situated at Aliyabad, Hyderabad, and to pass such other necessary orders. Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondents.

The contention of the learned counsel for the petitioner is that the petitioner is the owner of the house bearing Municipal No.18.4.372, Aliyabad, Hyderabad. It is further contended that the respondents without taking into consideration the title deeds filed by the petitioner rejected the claim of the petitioner as if the title is in dispute. A perusal of the record reveals that civil suits are pending in respect of the house bearing No.18-4-372. Learned standing counsel submitted that the respondents cannot provide a service connection without verifying the ownership of the house bearing municipal No.18-4-372. In view of pendency of civil litigation in respect of house bearing No.18-4-372, this Court is not inclined to express any opinion.

Taking into consideration the facts and circumstances of the

case, the petitioner is at liberty to make fresh representation to the third respondent for providing of electricity service connection to the house bearing municipal No.18-4-372. If any representation is made by the petitioner, the third respondent is directed to dispose of the same within one month from the date of making of representation by the petitioner.

With the above direction, the writ petition is dispose of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
