HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.24830 of 2014 ORDER:
The case of the petitioners is that the they purchased land admeasuring Ac.0-13 guntas in Sy.No.290 situated at Cheriapally Village, Ghatkesar Mandal, Ranga Reddy from its lawful owners and pattadars under registered sale deed bearing document No.6342 of 2007, dated 19-052007. They have made application before the 2nd respondent on 24-05-2007 for mutation of names of the petitioners in revenue records in respect of above lands. After receipt of application, the 2nd respondent conducted detailed enquiry and after calling for objections as contemplated under Section 5 (3) of A.P. Rights in Land and Pattadar pass books Act (for short" the Act") and since no objections were received, proceedings dated 12-07-2007 in D.Dis.No.B1/738/07 were issued directing the 3rd respondent to effect the mutation and submit the compliance report. Despite the said direction, the 3rd respondent has not taken any action. The petitioners also made application on 08-082014 to the 2nd respondent. Since no action has been taken, the present writ petition is filed.
Heard learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue.
Since it is stated that proceedings dated 12-07-2007 were issued by the 2nd respondent after conducting enquiry and after following procedure as envisaged under Section 5(3) of the Act, it is for the 3rd respondent to follow the same, unless there is any stay granted by the Courts or by higher authorities.
In view of the same, the 3rd respondent is directed to take action as per the proceedings of the 2nd respondent dated 12-07-2007 in D.Dis.No.B1/738/07 and pass orders, if there is no stay operating against the same. With the above direction, the writ petition is disposed o f . As a sequel to the disposal of this writ petition, miscellaneous petitions, if any, pending shall stand closed.
