THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.509 of 2019 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus declaring the inaction of the respondent authorities in passing orders for absorption of the petitioners as Contract Labours/Artisans pursuant to the individual representations dated 01.10.2018 and 03.10.2018 as arbitrary, illegal and unjust and sought a consequential direction to the respondents to consider the case of the petitioners for absorption as Contract Labours/Artisans.

Heard Sri N. Rajeshwar Rao, learned counsel for the petitioners, and Smt. A. Deepthi, learned Standing Counsel for the respondents.

It has been contended by the petitioners that they were initially appointed as Casual Labours on contract basis during the year 2008 and they were continued upto 2016 and thereafter, their services were not continued. The petitioners further contended that nearly 350 workers were absorbed against regular vacancies and the cases of the petitioners for absorption into service as regular workers were not considered. Therefore, the petitioners have submitted representations to the respondents on 01.10.2018 and 03.10.2018 to consider their cases for absorption into service as regular workers by duly taking into account the service rendered by them on contract basis, but so far

the respondents have not passed any orders on the said representations.

Learned counsel appearing for the petitioners contended that appropriate orders be passed in the writ petition directing the respondents to consider the representations submitted by the petitioners and pass appropriate orders in accordance with law. 5.

Learned Standing Counsel appearing for the respondents contended that all the vacancies were filled up, but however, contended that the representations submitted by the petitioners would be considered and appropriate orders would be passed in accordance with law.

This Court, having considered the rival submissions made by the parties, is of the view that this writ petition can be disposed of directing the respondents to consider the representations submitted by the petitioners on 01.10.2018 and 03.10.2018 and pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

With the above directions, the Writ Petition is disposed of. No costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
