THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.30227 of 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents.

2. The petitioner was appointed as a fair price shop dealer of shop No.566 of Suraram Colony, Quthbullapur Mandal, Ranga Reddy District. The authorization of the petitioner is valid upto 31.03.2017. While so, on 07.09.2015, the fifth respondent along with other officials inspected the shop and found some variations in the stock, for which, 6-A proceedings were initiated and they are pending. When the stock was not released for onward distribution to the cardholders for the month of September, 2015, the present writ petition is filed.

The learned Government Pleader, on the basis of instructions, submits that 6-A proceedings are pending and file is under circulation for issuance of show cause notice, but as on today, no disciplinary action was taken against the petitioner.

4. It is needless to mention that so long as the authorization of the petitioner is in subsistence, she is entitled to receive the essential commodities. In this case, the authoriastion of the petitioner found to be valid and in force as on today.

In the circumstances, the Writ Petition is disposed of directing respondents 3 to 5 to supply the essential commodities to the petitioner so long as her authorization is valid and in force. No order as to costs. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
