O R D E R
The petitioners assail the action of the Tahsildar, Attapur Village, Rajendranagar Mandal, Ranga Reddy District, in interfering with their possession over the extent of land admeasuring Ac.1.34 guntas in Survey No.435 and the extent of Ac.2.28 guntas in Survey No.446 situated at Hyderguda, Attapur Village, Rajendranagar Mandal, Ranga Reddy District. It is an admitted fact that the petitioners suffered an adverse order on 06.06.2017 in O.A.No.368 of 2010 (old O.A.No.119 of 2007) on the file of the Telangana Endowments Tribunal, Hyderabad. However, the petitioners thereupon filed C.M.A.No.594 of 2017 before the common High Court for the States of Telangana and Andhra Pradesh assailing the said order dated 06.06.2017 and by order dated 18.09.2017 passed in C.M.A.M.P.No.975 of 2017 in C.M.A.No.
594 of 2017, the common High Court for the States of Telangana and Andhra Pradesh granted interim stay of the operation of the order dated 06.06.2017 passed by the Telangana Endowments Tribunal, Hyderabad, in O.A.No.368 of 2010. These being the undisputed facts, it is not open to the Tahsildar, Attapur Village, Rajendranagar Mandal, Ranga Reddy District, to interfere with the possession of the petitioners over the subject lands at the behest of the Endowments authorities or the Religious Institution which were the applicants in O.A.No.368 of 2010 on the file of the Telangana Endowments Tribunal, Hyderabad.
The writ petition is accordingly disposed of directing the Tahsildar, Attapur Village, Rajendranagar Mandal, Ranga Reddy District, to abide by the interim order passed in C.M.A.No.594 of 2017 dated 18.09.2017 as
long as it remains in operation and not to interfere with the possession of the petitioners over the subject lands at the behest of the Endowments Department or the Religious Institution in question. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. _______________ SANJAY KUMAR, J 3rd JANUARY, 2019 Svv
