28.04.2025 JSR, J I.A.No.1 of 2025 This application is filed invoking the provisions of Section 528 of BNSS to relax the conditions imposed by this Court in order dated 10.01.2025 passed in Crl.P.No.29 of 2025.

Ramana Sarma, learned counsel for the petitioner and the learned Additional Public Prosecutor.

Learned counsel for the petitioner submits that the petitioner had filed Crl.P.No.29 of 2025 for grant of anticipatory bail in Crime No.331 of 2024 on the file of Station House Officer, Town Police Station, Jagitial, Jagitial District, and this Court by order dated 10.01.2025 allowed the said petition with certain conditions.

In condition No.(iii), the petitioner is directed to appear before the concerned Station House Officer on every Monday between 09:00 a.m.

and 05:00 p.m., till filing of the charge sheet and thereafter as and when required.

Learned counsel further submits that the petitioner has complied with all the

conditions stipulated in the said order and has appeared before the investigating officer. The petitioner is residing in old Alwal, Hyderabad, and it is becoming very difficult for him to appear before the investigating officer on every Monday as he has to travel for more than 500 kms and has to spend more than Rs.3,000/- for his expenses. He further submits that the investigation is completed and the presence of the petitioner is not required. However, the petitioner will appear before the investigating officer whenever his presence is required.

Learned Additional Public Prosecutor has not opposed the above said submissions of the learned counsel for the petitioner.

In view of the above said submissions, the application is allowed and condition No.(iii) imposed by this Court in Crl.P.No.29 of 2025 vide order dated 10.01.2025 is relaxed. However, the petitioner is directed to appear before the investigating officer whenever his presence is required and the other conditions shall continue.
