THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.14952 OF 2004 ORDER:
Heard the learned counsel for the petitioners. None appears for the respondents.
The case of the petitioners is that they have purchased an extent of Acs.17.50 cents situated in Survey No.85 of Rebaka Village, Nakkapalli Mandal, Visakhapatnam District, under registered sale deed dated 01.05.1984 and have been cultivating the same. The first petitioner executed a registered gift deed for an extent of Acs.5.50 cents on 22.03.1990 in favour of his grand son, the second petitioner. There is a Government land abutting the land of the petitioners in Survey Nos.86 to 90 in Rebaka Village, Nakkapalli Mandal, Visakhapatnam District. They have occupied the said land and submitted a representation for purchasing the said land at the market value.
On their representation, the District Collector directed the Mandal Revenue Officer (MRO), Nakkapalli Mandal, to take appropriate action for selling the said land by proceedings dated 04.10.1994. Thereafter, the MRO, Nakkapalli Mandal, inspected the land, conducted enquiry and submitted a report to the District Collector through the Revenue Divisional Officer (RDO), Narsipatnam. The RDO, in turn, addressed a letter to the MRO on 06.01.1999 to furnish some more documents for taking necessary action. As no further action was taken, the present Writ Petition was filed. The respondents have not filed any counter affidavit even after ten years.
In the circumstances, this Writ Petition is disposed of directing the respondents to take further action pursuant to the letter of the Sub Collector, Narsipatnam, in D.O.Rc.No.2035/98/C/Dt.06.01.1999 and communicate the results thereof to the petitioners within a period of three (3) months from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending
shall stand closed.
