HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 10382 of 2017 Order:

Heard learned counsel for the petitioner and learned Government Pleader for the respondents 1 to 4. Since no relief was granted in favour of the fifth respondent by the second respondent, the notice to the fifth respondent is dispensed with, as he is not an aggrieved person. The petitioner states that she is the absolute owner and possessor of agricultural land of an extent of Ac.4-04 gts., situated in Survey Nos.138/3 and 138/4 of Chunchupalli village and Mandal, Bhadradri Kothagudem district, having acquired the same under a registered document dated 09.12.1965. However, at the instance of the fifth respondent, the third respondent took up enquiry in LTR Case No.12/09/KGM under the provisions of the Andhra Pradesh Scheduled Areas Land Transfer Regulations Act, 1969, and dropped the proceedings.

Against the said order, the fifth respondent preferred an appeal before the second respondent in CMA No.14 of 2009, wherein an order was passed on 28.01.2017 directing the Tahsildar, Kothagudem to take over the suit schedule land into Government custody and evict the persons in possession of the same. Since the petitioner is in possession of the said property, she filed a revision petition before the first respondent on 28.02.2017 along with an application for stay. When the same is not disposed of till today, the present Writ Petition is filed. This Court is not inclined to entertain the present Writ Petition challenging the order passed by the second respondent dated 28.01.

petition, this Court is inclined to dispose of the Writ Petition with a direction to the first respondent to dispose of the revision petition filed by the petitioner herein, as expeditiously as possible, but not later than six

(6) months from the date of receipt of a copy of this order. In the meanwhile, the petitioner shall not be evicted from the possession of the above land. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
