HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.160 OF 2020 ORDER:

The present Writ Petition is filed being aggrieved by the order of the 2nd respondent in Order No.739/TSECL(PDP)/2015-MPTC(98), dated 20.01.2018 whereby the petitioner has been declared to be ineligible for a period of three years from the date of the impugned order to contest any election to be held for any office under the provisions of the Telangana Panchayat Raj Act, 1994, as illegal, arbitrary, unconstitutional.

Heard Sri T. Ramachander Rao, learned counsel for the petitioner and Sri P. Sudheer Rao, learned Standing Counsel for the State Election Commission for 2nd respondent and learned Government Pleader for Panchayat Raj for respondent Nos.1, 3 and 4.

Learned Counsel for the petitioner submits that the issue in the present writ petition is no longer res integra in view of the judgment of this Court in W.P. No.17075 of 2018 and batch, which was disposed of by this Court, by a common order dated 20.03.2019.

Learned Standing Counsel for Election Commission and learned Government Pleader for Panchayat Raj does not dispute the same.

Therefore, for reasons alike, the impugned order of the 2nd respondent dated 20.01.2018 is hereby set aside and this Writ Petition is allowed in terms of the order dated 20.03.2019 in W.P. No.17075 of 2018 and batch. No order as to costs.

As a sequel thereto, the miscellaneous petitions pending, if any, shall stand closed.
