THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12976 OF 2016 ORDER:
This petition is filed by the petitioners-A2 to A4 under Section 482 Cr.P.C. seeking to quash the proceedings against them in C.C.No.1997 of 2014 on the file of the III Additional Metropolitan Magistrate, Hyderabad. Heard and perused the material available on record. The petitioners are alleged to have committed the offence punishable under Sections 420 r/w 34 IPC. It is alleged that the accused raised hand loans from many people including the 2nd respondent-de facto complainant promising to repay the same with interest and subsequently, they filed Insolvency petition in the Court in order to avoid repayment of the borrowed amounts.
Learned Counsel for the petitioners submitted that the petitioners have not taken any amount from the 2nd respondent or any other person and they are no way concerned with the allegations made in the complaint.
Learned Additional Public Prosecutor opposed this petition. The truth or otherwise of the allegations against the petitioners can be decided after fullfledged trial. Therefore, this Court is not inclined to grant the relief sought by the petitioners. However, the presence of the petitioners before the trial Court is dispensed with except on the dates when their presence is specifically required by the trial Court. The petitioners are directed to be represented through a Counsel before the trial Court on all hearing dates.
Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed. ______________________ JUSTICE RAJA ELANGO Date : 2.9.2016 Nn
