Heard Ms.Avani Reddy for petitioner.

The order though appealable, this Court after perusing the order of respondent No.3 passed under the WALTA Act, is satisfied that the 3rd respondent has not considered the explanation in the background of relevant circumstances of Anantapur District much less the explanation offered by the petitioner that the bore well now directed to be seized was dug much earlier to the Act coming into force.

The consideration reads thus"

"The explanation submitted is not satisfied"

The consideration of 3rd respondent is merely excerpted to record that this Court is equally not satisfied with the decision making process of 3rd respondent. The proceeding dated 01.10.2014 is set aside and the writ petition is ordered. No order as to costs.
