HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.29328 OF 2017 ORDER:

The case of the petitioner is that he is working as Scavenger in 4th respondent organization since 1994 and discharging his duties to the satisfaction of authorities. That the petitioner has been paid wages of basic+DA+HRA every month for the last 20 years. The petitioner also approached the authorities for regularization of services. It is also stated that the 1st respondent issued instructions according approval for conversion of part-time sweepers to full time employees pursuant to the Board Meeting dated 22-06-2013. The petitioner made a representation dated 18-12-2013 seeking for absorption in permanent post. It is also stated that Central Industrial Tribunal, New Delhi gave direction to regularize the services of temporary employees, which was upheld by the Supreme Court in LIC of India v. Anil Kumar in C.A.No.

953-958/2005 vide its order dated 18-03-2015. The petitioner gave another representation on 21-06-2017. Even then the same is not being considered by the respondents though the Supreme Court gave direction in the civil appeal stated supra. Aggrieved by the same, the present writ petition is filed.

Heard learned counsel for the petitioner and Sri B.Ravi Kiran, learned Standing Counsel for the respondentCorporation.

Since already the grievance of the petitioner is pending before the respondents by way of representation, there shall be direction to the respondents to consider the same and pass orders in accordance with law by taking the above facts into account. The said exercise shall be done within a period of eight (08) weeks from the date of receipt of a copy of this order. It goes without saying that if the petitioner is continuing, he will be continued with same set of conditions. Accordingly, the writ petition is disposed of. No costs.
