THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY APPEAL SUIT No.669 of 1997 JUDGMENT:

Though the matter is listed under the caption 'for dismissal', the colleague of Sri M.Sivananda Kumar, the learned counsel for the appellant, sought time and requested this Court to pass over for few minutes. Again called at 2:15 PM, but none represented on behalf of the appellant and again called at 3:20 PM even then, nobody represented on behalf of the appellant despite reporting readiness by the learned counsel for the respondents.

Hence, the Appeal is dismissed for non-prosecution but without costs in the circumstances.

Consequently, Miscellaneous Petitions, if any, pending in this Appeal shall stand closed.
